Terms and Conditions of the Affiliate Program

Welcome to the Executive Advertising Affiliate Program! These Terms and Conditions ("Terms") govern your participation in our affiliate program. By signing up as an affiliate, you agree to comply with all the terms below. Please read them carefully and review them regularly for updates.

1. Eligibility

• Affiliates must be 18 years or older to participate.
• Participation is subject to approval by Executive Advertising and may be revoked at any time at our sole discretion.
• The Executive Advertising Affiliate Program is currently only open to U.S.-based affiliates. Applicants must reside in the United States and have a valid U.S. mailing address and tax identification number.

2. Ethical Marketing and Conduct

Affiliates must:

• Use ethical marketing practices and accurate representations of our products.
• Avoid misleading or false advertising in any form.
• Not engage in any form of fraudulent behavior, including self-referrals.
• Ensure all promotional activity complies with local, state, federal, and international laws.
• Failure to comply may result in immediate termination from the program and forfeiture of any earned commissions.

3. Commission Structure and Payouts

• Commission is earned on qualifying purchases made through the affiliate’s unique tracking link or coupon code.
• VIP Memberships are not commissionable.
• Affiliates cannot earn commissions on their own purchases.
• A minimum payout threshold of $50.00 must be met to receive a commission payment. (This threshold will be specified on your affiliate dashboard.)
• Payouts are approved on or around the 15th of each month for commissions earned from orders delivered in the prior month.
• Payouts are processed at the beginning of each month.
• Payments are made via the method selected in your affiliate dashboard.
• In accordance with IRS regulations, affiliates who earn $600 or more in a calendar year are required to provide a valid Social Security Number (SSN) or Employer Identification Number (EIN) for tax reporting purposes. Failure to provide this information may result in delayed or withheld payments.

If a customer order is later refunded or altered after being marked as delivered (e.g., due to claims, returns, or special adjustments), Executive Advertising will absorb any resulting cost. Affiliates will not be debited or asked to return commission for these post-delivery settlements.

4. Tracking & Attribution

• Our affiliate program uses browser cookies to track referrals. The cookie duration is 90 days.
• If a customer clicks on multiple affiliate links within the 90-day window, the most recently clicked link will be credited, unless the customer enters a valid affiliate coupon code at checkout. In that case, the coupon code takes priority.
• While we strive to ensure tracking works across all platforms, we are not responsible for lost commissions due to cookie blockers, browser issues, ad blockers, or other technology limitations.

5. Prohibited Practices

Engaging in any of the following activities will result in immediate removal from the affiliate program and forfeiture of commissions:

• False advertising or misrepresenting Executive Advertising or its products.
• Spamming or sending unsolicited messages (including emails, texts, or DMs).
• Promoting links on adult, gambling, or black hat websites.
• Promoting links on thin content sites or misleading product reviews.
• Cookie stuffing or any attempt to manipulate tracking cookies.
• Commission fraud or fabricated referrals.
• Using unauthorized or fake coupon codes to promote our products.
• Promoting links or codes on RetailMeNot or similar coupon platforms.
• Attempting to hack, manipulate code, or interfere with the website.
• Bidding on our brand name or trademarks in paid search advertising.
• Using our logo, company name, or trademarked materials without permission.
• Engaging in hate speech, illegal activity promotion, or unethical content.

6. Program Modifications and Termination

• We reserve the right to change commission rates, coupon code discounts, or other program details at any time, with or without notice.
• We reserve the right to terminate any affiliate account at our sole discretion and for any reason.

7. Technical Limitations

While we strive to ensure our affiliate platform works seamlessly, we are not liable for issues arising from:

• Website downtime or latency.
• Bug-related tracking errors.
• Cookie-blocking browsers or extensions.

8. Governing Law

This agreement is governed by the laws of the State of Tennessee. Any disputes arising under or related to this program shall be resolved exclusively in the courts located in Sumner County, TN.
